This is our Customer Agreement.

Your privacy is important to us.

We understand the need for IT personnel confidentiality and for the privacy of your data. We do not, and will not ever, collect or use your data in a manner inconsistent with the services we provide. Our strict policies of non-disclosure and stringent security are in place to keep your data safe and earn your trust.

Our hardware warranty protects your purchases.

Our limited hardware warranty covers defects in materials and workmanship in your BrokenBungee-branded hardware products for the first year following purchase, excluding problems that result from external causes such as accident, abuse, misuse, or problems with electrical power; servicing not authorized by us; or by accessories not supplied by us.

We value fair pricing.

As with all services, an occasional adjustment to our pricing structure may be required. Typically, any adjustments in pricing will occur in the first quarter of the year and you will be notified of changes in advance of billing. We are, of course, fully committed to maintaining your business through the value and competitive pricing of our services.

YOUR OBLIGATIONS:

You are responsible for ensuring that your data is not in violation of any other parties copyrights or claims or claims of ownership; any data that we may assist you with in either storing, transmitting, or otherwise, is based on your assurance to us that you have the legal right to do so. Further, you may not use our services in any manner that is illegal, fraudulent, improper, or unreasonable in volume. Also, unless we have been retained to and have agreed to provide a data backup service for you, you are responsible for maintaining the integrity of your data, to include providing for redundancy.

 

PAYMENT:

Service and subscription charges are billed on the 15th day of the month and are due on receipt; charges will include subscription fees for the current calendar month and any service fees incurred since the previous invoice. Hardware and software charges and associated fees are generally billed on delivery and due on receipt; large or special orders may require a down payment, which we will discuss with you in advance.

 

RETURNS:

We understand that a piece of hardware or software may occasionally be ordered from us in error. In this event, you may return the un-used, un-damaged item to us within 15 days. However, we will charge a minimum 20% restocking fee, which may be larger to reflect our actual shipping and restocking costs.

 

SHIPMENTS:

We understand that at times, you may prefer for your convenience that we ship an item to you, as opposed to delivering or installing the item in person. In this event, we will ship through FedEx with the service speed you request and will insure the parcel for the full value of the contents. You will be responsible for the shipping, handling, and insurance fees and will be provided the parcel tracking information if so requested.

 

SUBSCRIPTIONS:

Our subscription services generally require a minimum initial commitment of 12 months; if you cancel the subscription within the initial commitment, you will be responsible for any remaining charges. After the initial term, the subscription will convert to a monthly commitment which may be canceled at any time. Also, our services may include the use of or access to software or services provided by one or more third parties; you will be notified of these third party providers and applicable terms/conditions and will be obligated to comply with those terms/conditions.

 

TERMINATION:

Upon termination of any service or removal of an individual device from any service, we reserve the right to remove any of our authentication keys or certificates which may be installed prior to releasing administrative control of the affected device and we also reserve the right to ensure, through verification, that you convert any BrokenBungee provided non-perpetual software licenses to perpetual use licenses through a buy-out option or uninstall the above-mentioned software. For subscriptions in which your data is stored on our systems, we will maintain that data, at your cost, for up to 60 days following service termination at which time it will be permanently deleted; during this period we will assist you with transferring your data to another system, service, or account, at your cost.
